Este trabajo se propone mostrar cómo la Teoría Neoclásica de la Ley Natural fundamenta la existencia de normas morales absolutas, cuál es su relevancia para la filosofía moral, y qué críticas pueden ser formuladas a la argumentación de los autores. Ellos postulan que la ley natural, mediante normas, lleva a elegir y proteger bienes humanos básicos, correspondientes a los diversos aspectos de la naturaleza humana, evitando su destrucción, daño o impedimento. Aunque la mayoría de las normas morales admiten excepción, nunca (...) lo hacen las que prohíben realizar un acto que siempre daña directamente un bien básico, pues tal acto no puede compatibilizarse con la propia autorrealización, y atenta contra la dignidad humana. La división del trabajo tomará la siguiente forma: en los primeros cuatro apartados se abordarán los conceptos clave para la defensa de una norma absoluta en la Teoría Neoclásica, en el quinto se enlazarán los conceptos al modo que los autores lo hacen para demostrar la existencia de absolutos morales y someter el consecuencialismo a crítica, y en el sexto se hará una breve revisión crítica de los argumentos presentados. En el presente texto se hace una lectura fenomenológica del relato mítico amazónico del Yurupary. A partir de esta, se defiende la tesis de que en la oralitura que se manifiesta en este relato se ofrece la cosmovisión de una cultura precolombina; en esta, se plasma en su estructura interna una determinada manera de estar-en-el-mundo, es decir, devela rasgos de la dimensión ontológica de la misma. The definition and measurement of the impact of laws and courts is a subject of disagreement and uncertainties. In this article, law is understood as a public, general, and binding command enforceable through state coercion. Assessments on the effects of laws on democracy and development focus on changes in specific social indicators. The evaluation of impact relates to the availability and reliability of judicial statistics and the impact of laws depends on political and social conditions. The interaction of laws can (...) be studied in three contextual variables: the structure and competitiveness of political systems, the structure and performance of the judiciary, and the organizational endowments of the social or political actors, such as social and labor movements that use the law. This interaction shows how and why certain conditions affect impact. It also speculates, about some additional developments that might follow from the relationships between law and these three variables. (shrink)

This paper re-evaluates the role that Plato confers to pleasure in the "Philebus." According to leading interpretations, Plato there downplays the role of pleasure, or indeed rejects hedonism altogether. Thus, scholars such as D. Frede have taken the "mixed life" of pleasure and intelligence initially submitted in the "Philebus" to be conceded by Socrates only as a remedial good, second to a life of neutral condition, where one would experience no pleasure and pain. Even more strongly, scholars such as Irwin (...) have seen the "Philebus'" arguments against false pleasures as an actual attack on hedonism, showing -- in Irwin's words -- "why maximization of pleasure cannot be a reasonable policy for the best life." Against these claims, I argue that the mixed life of pleasure and intelligence is presented in the "Philebus" as a first best and not just as a second best for humans, and that, accordingly, Socrates proposes to incorporate -- rather than reject -- pleasure as one of the intrinsically desirable aspects of the happy life. Thus, I offer alternative readings of controversial passages that have given rise to the prevalent interpretation criticized here, and advance positive evidence that at least some pleasures are seen by Plato as inherently good. In addition, I demonstrate that Plato's arguments against false pleasures do not by themselves constitute an attack on hedonism. Rather, they can be seen as a strategy to show the hedonist that, in order to be a maximal, or even a consistent, hedonist, he should go for true, and not fake pleasures, if after all pleasure is the object of his pursuit. But, since this cannot be achieved without intelligence, then the mixed life of pleasure and intelligence is to be accepted even by hedonist themselves. (shrink)

The selfish goal metaphor is interesting and intriguing. It accounts for the idiosyncrasies and inconsistencies in peoples' goal pursuits without invoking free will, self-regulatory, or self-control failures. However, people pursue multiple goals, sometimes simultaneously. We argue that the model proposed in the target article may gain significant theoretical and practical value if the principles underlying goal selection and/or balancing on a moment-to-moment basis are clearly specified and integrated with the notion of the selfish goal.

In this paper I re-examine the status of the mind-body relation in several of Plato’s late dialogues. A range of views has been attributed to Plato here. For example, it has been thought that Plato is a substance dualist, for whom the mind can exist independently of the body; or an attribute dualist, who has left behind the strong dualistic commitments of the Phaedo by allowing that the mind may be the subject of spatial movements. But even in cases where (...) a classification of Plato as a holder of a particular ontology of the mind has been left undefined, it has been a shared assumption that in the late dialogues the mind itself must be immaterial. I take issue with these various views and show that none of them is necessitated by the text. In the first place, I argue there is strong evidence against the view that Plato should, in his late period, be committed not only to substance dualism, but also to attribute dualism. Furthermore, it is possible that Plato may have allowed that the mind itself be a three-dimensional corporeal entity (in a way that sets up a precedent for later Stoic developments). But even if this is not the only possible reading of the text, it is shown how at any rate the mind must be seen in late Plato as the principle of organization of a body and ontologically inseparable from it. Despite prima facie affinities with Aristotle here, we shall see a Plato emerge for whom the mind (without exception) and the body cannot exist without one another – a thesis more radical than that of Aristotle’s. To bring out the provocative nature of this suggestion, I start, in section I, by laying out the state of the question and compare what I shall argue is the late Platonic view with standard interpretations of his previous work, stressing the historical force that I expect this thesis to have. Afterwards, in three respective sections, I proceed to pay heed to relevant passages in the Timaeus, Philebus and Laws in order to establish the main point of this paper. Finally, in section V, I consider the challenge apparently introduced against my thesis by Plato’s occasional talk of immortality and eschatology in those dialogues, and argue instead that many of those passages add further strength to the view defended in this essay. The paper argues that reflective judgments presuppose an agent determined by discursive functions. In order to demonstrate that there is a discursive or narrative subject in Arendt, the following issues are dealt with. First of all, that there is a direct relation between the political subject and its space of emergence or degree of publicity. In this sense, the subject is not just any subject, but rather one who has the possibility of appearing before others. This experience makes it possible to think of human action in a certain way. Reflective judgments operate on particular cases that enable the emergence of a discursive subject that orients action. Secondly, the purpose of this analysis is to find out whether it is possible or legitimate to think discourse as a strictly narrative resource, and to inquire into Arendt's position in this respect: is it possible to think about reflective judgments on the basis of that which is narrated? This question leads to our conclusion, since the possibility of thinking about that which is narrated on the basis of reflective judgments presupposes a specific subject with certain prior characteristics that enable the categories of the visible, of the invisible, and of appearance and reality. Empirical research in bioethics has developed rapidly over the past decade, but has largely eschewed the use of technology-driven methodologies. We propose “design bioethics” as an area of conjoined theoretical and methodological innovation in the field, working across bioethics, health sciences and human-centred technological design. We demonstrate the potential of digital tools, particularly purpose-built digital games, to align with theoretical frameworks in bioethics for empirical research, integrating context, narrative and embodiment in moral decision-making. Purpose-built digital tools can engender situated engagement (...) with bioethical questions; can achieve such engagement at scale; and can access groups traditionally under-represented in bioethics research and theory. If developed and used with appropriate rigor, tools motivated by “design bioethics” could offer unique insights into new and familiar normative and empirical issues in the field. (shrink)

THE TENTH BOOK OF THE LAWS, which contains Plato's last word on cosmology and theology, has often been considered as presenting Plato's views in a more exoteric way in contrast with the more esoteric style of the Timaeus. And there are good reasons to think that this view is correct. Whereas the Timaeus stresses that "to find the maker and father of this All is difficult, and, having found it, it is impossible to communicate it to the crowd", Plato is (...) in Laws 10 intending to establish a "proemium" or rational foundation for his laws against impiety, which are supposed to be known by all. In this proemium Plato tries to argue for three propositions: that the gods exist ; that they take care of human affairs ; that they cannot be bribed by sacrifices or prayers. The underlying assumption is that learning these facts about the gods will also help to prevent impiety which, like any kind of vice, is often due to ignorance. (shrink)

Este trabajo busca analizar los personajes que Tácito destaca como dignos de mérito durante el nuevo sistema político del Principado y que reciben una alabanza o elogio por parte del historiador en la primera héxada de sus _Anales. _Se examinan también los factores que se constituyen como meritorios bajo el reinado de Tiberio y que reciben algún tipo de compensación política por parte del emperador.

Although a great deal has been written on Plato's ethics, his cosmology has not received so much attention in recent times and its importance for his ethical thought has remained underexplored. By offering accounts of Timaeus, Philebus, Politicus and Laws X, the book reveals a strongly symbiotic relation between the cosmic and human sphere. It is argued that in his late period Plato presents a picture of an organic universe, endowed with structure and intrinsic value, which both urges our respect (...) and calls for our responsible intervention. Humans are thus seen as citizens of a university that can provide a context for their flourishing even in the absence of good political institutions. The book sheds light on many intricate metaphysical issues in late Plato and brings out the close connections between his cosmology and the development of his ethics. (shrink)

Adolescents who believe that their parents treat them differently from their siblings have poorer psychosocial well-being than otherwise. This phenomenon, which is known as parental differential treatment or PDT occurs in up to 65% of families. Past studies have examined socio-demographic variables (e.g., child gender, age, and birth order) as predictors of PDT, but these immutable characteristics do little to inform interventions and help these adolescents. Hence, this study extends past research by investigating links among parent empathy, parent perception of (...) PDT, child perception of PDT, child perception of fairness and child well-being (self-esteem, depression, anxiety, and trust in the relationship with parents). Furthermore, this study tests whether adolescent personality (openness, conscientiousness, extraversion, agreeableness and neuroticism), child empathy, and child perception of fairness moderate these links. This study will utilize a two-wave longitudinal design with a one-year lapse. Data will be collected from 760 Chinese adolescents studying from Secondary One to Secondary Three in 18 schools in Hong Kong and from their parents. We test our theoretical model via a multilevel structural equation model. This study both addresses (a) theoretical debates about relations among empathy, PDT, fairness, and psychosocial well-being and (b) focuses on modifiable factors and behaviors, to inform future interventions, such as parent education. Adam Smith and David Hume agree that first-level general rules of morality may be discovered by induction, and that reflection on these rules may influence human behavior. But Hume thinks a deeper, second level of moral general rules may also be discovered, and used to correct erroneous first-level rules. Thus on Hume's view, some reasoned reflection may be needed in order to feel the proper moral sentiment. Smith holds that, because of human inclination toward selfishness, first-level moral rules should be (...) habitually used to override immediate impulse in the motivation of behavior. This is a valuable habit, but since most people are not able to form such rules for themselves, it is a good idea for them to follow moral rules provided by religion. There is something respectable, according to Smith, in sincerely following flawed moral rules provided by religion. Hume disagrees, holding that it is foolish and blameworthy, indeed dangerous, to follow flawed moral rules provided by religion. (shrink)

Recent research has shown that the corporate social responsibility system has a positive impact on consumer behavior regarding products or services that promote social responsibility. Thus, it can be stated that customer loyalty to a particular company derives not only from commercial benefits but also from the components of corporate social responsibilities practiced by the company. The vast majority of company managers in Romania do not understand what it means to be a socially responsible company, which is why they do (...) not even agree with most of the definitions given to corporate social responsibility; secondly, when asked to explain what social responsibility means, they are not able to make logical arguments; I argue that the involvement of companies in social responsibility activities has a purely economic motivation and that it is related to the size of the company, rather large companies integrating the implementation of CSR activities in its vision. From a marketing perspective, corporate social responsibility has proven its ability to generate many benefits for companies, implementing and communicating specific policies and actions in this regard with the potential to improve satisfaction and loyalty, both among customers and of employees. The main objective of the article is to analyze the way in which consumers in Romania perceive the corporate social responsibility system of companies. (shrink)

Abstract:In this article, we present a pragmatic approach to neuroethics, referring back to John Dewey and his articulation of the “common good” and its discovery through systematic methods. Pragmatic neuroethics bridges philosophy and social sciences and, at a very basic level, considers that ethics is not dissociable from lived experiences and everyday moral choices. We reflect on the integration between empirical methods and normative questions, using as our platform recent bioethical and neuropsychological research into moral cognition, action, and experience. Finally, (...) we present the protocol of a study concerning teenagers’ morality in everyday life, discussing our epistemological choices as an example of a pragmatic approach in empirical ethics. We hope that this article conveys that even though the scope of neuroethics is broad, it is important not to move too far from the real life encounters that give rise to moral questions in the first place. This paper deals with Plato’s theoretical views on rhetoric, its value, its conditions, and its genuine ethical-political function. My goal is to show that, even from the theoretical and/or metarhetorical point of view (Gorgias and Phaedrus), Plato would admit the practice of arguing from probabilities (eikós) and opinions, and would accept as a legitimate part of rhetoric –in order to persuade the mob– devices such as appeals to emotion. As it is well known, concrete uses of these devices can be (...) found in the dialogues. I will refer, in this vein, to some passages of Plato’s political writings, esp. Republic and Laws, and to the role of some myths in the dialogues. Nonetheless, I sustain the necessity (and the possibility) of harmonizing this view, with Plato’s strong claim that knowledge of (and commitment to) an objective truth is essential to the true rhétor. In this review, we present some ethical imperatives observed in this pandemic from a data ethics perspective. Our exposition connects recurrent ethical problems in the discipline, such as, privacy, surveillance, transparency, accountability, and trust, to broader societal concerns about equality, discrimination, and justice. Worldwide interest in understanding art and creative practices as valid forms of knowledge production has led to the establishment of research-creation as an interdisciplinary academic field in the last twenty years in Canada as elsewhere. Its establishment relates to a growing interest in critical making and technological innovation and to the legacies of feminism(s) and its critique of the power dynamics of knowledge production within academia. This article outlines a series of interactive projects that bring visibility to Latin American women (...) in art, science and technology and speculates on the legacies of feminism(s) in the emergence of research-creation. The four projects discussed build on each other and explore re-mediation, re-activation and re-enactment as part of a collaborative feminist research-creation methodology. I theorize their potential to activate political memory by highlighting how these three approaches to creation share a preoccupation for revisiting the past through repetition, iteration and the facilitation of intergenerational encounters among humans, non-humans and across media and technologies. While discussing the feminist orientation of these approaches, I suggest a critique of dominant modes of knowledge production that have obscured the contributions of Latin American women and offer four research-creation interventions in the media arts archive. In this paper, I set out to refute several charges that have recently been raised against Plato’s attitude toward the environment and to present him under a new light of relevance for the contemporary environmental debate. For this purpose, I assess the meaning of Plato’s metaphysical dualism, his notion of nature and teleology, and the kind of value that he attributes to animals, plants, and the land in general. I thus show how Plato’s organicist view of the universe endows it (...) with an intrinsic value that is over and above each of its parts, including humans, and provides an argument for the preservation of species of nonhuman animals, which in many relevant ways are not ranked below the human species. In addition, I show how Plato’s dialogues provide good evidence for human concern about the environment and how such a concern is promoted rather than hindered by his nonanthropocentric notion of teleology. In this article the relations between philosophy and applied ethics are considered. The presented deliberation is concentrated on the question whether philosophy has contributed to applied ethics, especially to business ethics. Trying to find an answer to this question I will refer to the discussion which was started by R. Rorty in which he presented his own point of view on the issues related to moral development and the role of philosophy and philosophers in the modern world. Rorty points at (...) proper tools which, in his opinion, can be helpful to business ethicists and formulates the goal they should try to aim at. His opinions has started a vivid discussion. Patricia H. Werhane, Daryl Koehn and Richard T. De George try to discuss with Rorty’s statement. They oppose Rorty’s argument that philosophy is not more relevant to applied ethics than any other academic disciplines. They point to the facts which document philosophers’ contribution in forming business ethics. This article presents their arguments as well as an attempt of their critical assessment. (shrink)

From the outset of scholarly research on Cusanus, the question concerning the historical status of his original philosophy has been a constant issue in thesecondary literature. One continuously encounters the question of whether he is a medieval or a modern thinker, with a number of conflicting interpretations. These viewpoints are, in many cases, less related to concrete historical arguments than to general considerations regarding what it is meant by “medieval” or “modern” from a theoretical point of view. Accordingly, scholarship on (...) Cusanus’s position in the history of ideas has been strongly influenced by the unconscious historiographical attitude of his interpreters. (shrink)

The paper is focused on the process that creates prepositional phrases in Spanish, from the perspective of the theory of grammaticalization and cognitivism, tracking semantic transformations through associative processes such as metaphor and metonymy. After reviewing these theoretical bases, the research follows two particular expressions in the Spanish prepositional phrases inventory: en cabeza de and a la cabeza de. The analysis starts by the study of the central noun, cabeza, in historic dictionaries, followed by a study of their use in (...) the main academic corpus. The aim is to observe how these expressions have changed diachronically to establish when and how they have become fixed phrases in the Spanish language. (shrink)

Patentowanie ludzkich genów jest zjawiskiem, które w obecnych czasach nabrało intensywności i znaczenia. Jest jedną z kluczowych form zabezpieczania praw własności przemysłowej, zwłaszcza dla ośrodków badawczych i koncernów farmaceutycznych. Ze względu na naturę produktu podlegającego opatentowaniu, pomysł patentowania genów budzi wiele kontrowersji i rodzi spory na różnych płaszczyznach. Celem artykułu jest naszkicowanie ram prawnych dla tego zjawiska (m.in. porównanie regulacji europejskich i amerykańskich) oraz krytyczne omówienie argumentów przemawiających zarówno w obronie tej procedury, jak i przeciwko niej, wysuwane z różnych perspektyw: (...) prawnej (kwestia posiadania przez geny tzw. zdolności patentowej, kontrowersje związane z prawem własności do ludzkiego ciała), społeczno-ekonomicznej (wpływ zjawiska na rozwój badań naukowych oraz na ceny leków i dostępność różnych terapii) oraz etycznej (omówionej na podstawie wybranych kazusów). El desconocimiento del sentido tradicional de estos conceptos conlleva consecuencias semánticas relevantes para la disciplina. The focus on this article is to analyze the concept of beauty in Kierkegaard’s thought, starting from some questions that I try to answer in these pages: How does Kierkegaard understand beauty? What role does beauty play in the inner constitutive process? All this to argue that, as regards beauty, Kierkegaard recovers the Greek concept of kalokagathia to give it a modern interpretation; thus, distancing himself from the modern understanding of beauty as a mere object of study of aesthetics or (...) the mere contemplation of an ideal; beauty is defined as the telos of the inner self and is related to freedom and choice. It is, therefore, as I will argue, an ethical beauty, rather than an aesthetic one. (shrink)

This article analyzes the innovations produced by the concept of experience, introduced from the feminist theory during the eighties. The experience was an epistemic invention to give account of what used to result exceeding, subsidiary, or invisible to the science legitimated as such. This theoretical-methodological tool led to redefinitions around the sense of objectivity and pointed out the political condition of a perspective that was declared as neutral. This work tries to throw some light over the critical strength that this (...) epistemic tool had during those years, for which it chooses the historical perspective. At the same time, this article advances towards a critical analysis around certain modelling of the tool. In this sense, the article aims to sharpen the epistemic surveillance and to review the commitments that this has been acquiring with the institutionalization of the feminist perspective during the last decades. El presente artículo analiza las innovaciones que produjo en el campo del conocimiento la herramienta de la experiencia, introducida desde la teoría feminista en los años ochenta. La experiencia fue una invención epistémica que tuvo como objetivo dar cuenta de aquello que resultaba excedente, subsidiario o invisible a la ciencia legitimada como tal. Este instrumental teórico-metodológico conllevó redefiniciones en torno al sentido de la objetividad y señaló la condición política de una perspectiva declarada neutral. El presente trabajo apunta a alumbrar la potencia crítica que dicha herramienta epistémica tuvo en aquellos años, para lo cual elige la perspectiva histórica. Asimismo, el artículo avanza en un análisis crítico en torno a ciertas modelizaciones contemporáneas de dicha herramienta. En este sentido, el artículo aspira a agudizar la vigilancia epistémica y a revisar los compromisos que ha ido adquiriendo con la institucionalización de la perspectiva feminista de las últimas décadas. Esse artigo propõe uma reflexão ontológica não-essencialista e não-naturalista acerca do humano, a partir de alguns conceitos próprios a hermenêutica filosófica de Gadamer, que sirva de fundamentação para o desenvolvimento de uma filosofia da educação hermenêutica que, por sua vez, avança preocupada com o papel da filosofia nas escolas. Enquanto parte de um trabalho maior, que vem sendo desenvolvido enquanto tese de doutorado, o objetivo desse texto é apresentar, de um modo geral e introdutório, os principais argumentos que sustentam a (...) proposta de uma educação filosófica e hermenêutica, a qual se insere no processo de formação existencial dos educandos. The practice of theoretical research in chemistry largely consists in the construction of models without which experimentation would be impossible. The best-known theoretical models in chemistry are those of the molecular structures of chemical compounds. What is the correspondence between these models and the unobservable entities that they are meant to explain? What is the ontological status of molecular models? The anti-realists question the basis of the realists’ belief in these entities and the truth claims regarding them. Ultimately, the realist/anti-realist (...) debate points to the question of the scope of scientific knowledge. In this paper, I shall show that the description of natural entities offered by the contemporary scientific worldview reveals that molecular modeling presupposes a realistic epistemology that recognizes the limits of scientific objectification. On Miranda Fricker’s influential account, the central case of testimonial injustice occurs if and only if the speaker receives a credibility deficit owing to identity prejudice of the hearer. Her critics have taken issue with her view, arguing that cases in which speakers are given more credibility than they deserve, may also amount to testimonial injustice. Furthermore, they argue, these cases cannot be captured by Fricker’s account of objectification as the primary epistemic harm of testimonial injustice; rather, it is an (...) account of othering that best captures a wide range of epistemic injustices. In this paper, I join Fricker’s critics in advancing a novel case of testimonial injustice through identity-prejudicial credibility excess – the adultification of black girls in testimony-giving settings. When testifying, black girls are likely to receive a credibility excess with respect to adult topics such as sex and consent because they are perceived as older, more self-reliable, and mature than they actually are by the hearers. Nevertheless, when examining the girls’ intersecting social identities defined by age, race and gender, it becomes clear that this constitutes an unjustly and prejudicially inflated estimation of their credibility. These cases also involve hermeneutical injustice since the identity-prejudicial credibility excess denies the victims a meaningful opportunity to make sense of their traumatic experiences of sexual assault. I conceptualize this compounded injustice as testimonial obfuscation, where an identity-prejudicial credibility evaluation (either in excess or deficit) causes an experience to remain unintelligible to the hermeneutically marginalized speaker. This work is the first monograph devoted to the interpretation of Aristotle’s theory of chance in Physics II 4-6 and its implications and projections in other treatises, including an original and comprehensive account of the Aristotelian conception of chance, of accidental causality in the realm of nature, and of accidental causality in the realm of human action. One of the main interpretative issues around Aristotle’s discussion of chance is its relation to the four causes and to teleology. In this sense, (...) it is particularly difficult to find the common features which fortune (tyche) and spontaneity (automaton) share. This work, offers such an interpretation of Aristotle’s general concept of chance (i.e. common to fortune and spontaneity), which shows clearly its relation with his theory of causality (Phys. II 3), with teleology, and with the application of this theory to the study of nature. It also shows how fortune and spontaneity can be interpreted consistently with this general characterization of chance, and how the specific differences between them can be accounted for paying attention to the different structures of causality in the realm of nature and in the realm of human action. Regarding the specific concept of spontaneity (automaton), a crux interpretum, the book offers one of the few independent discussions this issue in Aristotelian literature, and proposes a sub-classification in two kinds of spontaneity based on an analysis of Aristotle’s different examples and characterizations: ‘mixed spontaneity’ (which shares some features with fortune), and ‘pure spontaneity’ (which takes place strictly in the realm of nature). These different structures had not been recognized in specialized literature before. The problem of chance has projections into Aristotle’s natural philosophy, as well as into Aristotle’s theory of action and practical philosophy. This ample perspective of Aristotle’s work, and of the different explanatory models and ontological structures therein involved, constitutes an interesting groundwork for future developments in some or many of these realms of investigation. Este artículo problematiza la forma en la que el feminismo ha interpretado al escepticismo como una amenaza para su proyecto epistemológico, ético y político, y plantea que, a pesar de dicha interpretación, el escepticismo es inherente a la filosofía feminista y un aliado útil para su proyecto. El problema ha estado en cómo el feminismo ha reducido su comprensión del escepticismo a una versión cartesiana extrema y ha pasado por alto otras corrientes de la tradición —como la de David Hume— (...) que podrían ser fructíferas para promover una actitud crítica y emancipatoria. Muestra así como una alianza entre una comprensión moderada del escepticismo y el feminismo puede brindar las herramientas necesarias para cuestionar formas de dominación patriarcal y poner en marcha investigaciones que combatan la opresión de género.
